Terms of Service for Dires

1. Acceptance of Terms
1.1. Agreement: The relationship between Dires Hosting or diresnode.com ("Provider" or "Company") and Clients, Customers, and Users (referred to as "Guests") is defined by these terms. Use of our services signifies agreement to these conditions, including our Privacy Policy.
1.2. Additional Terms: Specific guidelines or conditions may apply at various "checkpoints" on our Platforms. Users are required to comply with these additional terms while accessing our services.
2. User Eligibility
2.1. Qualification: Users ineligible for service access include those incapable of forming legal contracts, individuals under 13 years old (without parental/legal guardian consent), persons restricted from receiving services by UK laws or relevant jurisdictions, suspended users, and those lacking valid communication methods with our website.
2.2. Right to Refuse: Dires Hosting reserves the right to decline registration for any entity or person at its absolute discretion. No rights or obligations under this agreement can be transferred or assigned without prior written consent.
3. Changes to Terms
3.1. Modifications: Dires Hosting retains the right, at its sole discretion, to modify or replace any part of this Agreement. Users must regularly review these terms for any changes. Continued use of our services following alterations constitutes acceptance of the modified terms.
3.2. Service Enhancements: Dires Hosting may introduce new features/services through the Platforms. Such additions are subject to these terms and conditions.
4. Indemnification and Service Refusal
4.1. Liability Waiver: Users agree to hold Dires Hosting free from liability, losses, expenses, and claims resulting from their negligence or indirect actions. The user holds harmless all employees, directors, suppliers, and associated individuals, unless otherwise stated by governing law.
4.2. Service Termination: Dires Hosting reserves the right to refuse, cancel, or terminate services for users engaged in unlawful activities or violating the terms, privacy policy, or at the sole discretion of Dires Hosting management. Termination due to policy violations does not warrant refunds.
5. Refunds and Cancellations
5.1. Refund Policy: Users have a Seventy-Two-hour timeframe from the order placement to request refunds without reasons. However, limitations apply to specific services, add-ons, dedicated servers, or upgrades. Refunds are non-applicable after this period or in cases of user-induced downtime, lack of support, or terminations based on terms of service.
5.2. Renewals: Services undergo renewal processes outlined in our policy. Failure to settle invoices within specified periods may lead to service suspension or termination.
6. Account Security and Usage
6.1. User Responsibility: Users must safeguard their account credentials, assume responsibility for account actions, and ensure account security. Exploiting software or hardware flaws, circumventing security features, engaging in attacks, or interrupting services are strictly prohibited.
6.2. Account Credit: Account credit cannot be withdrawn.
7. Affiliates and Regulations
7.1. Affiliate Program: Dires Hosting operates an affiliate program, enabling clients to refer others for credit. Specific regulations govern this program, prohibiting misuse, abuse, or improper linkage of referral URLs.
7.2. Restrictions: Promotional, review, and discount sites cannot be used with the affiliate system. Dires Hosting reserves the right to refuse payouts, close accounts, or modify the affiliate system as deemed necessary.
8. Services Offered
8.1. Web Hosting and Discord Bot Hosting
Defined Services: Dires Hosting exclusively provides web hosting and Discord bot hosting services.
Service Policy: Users availing these services must adhere to the specified usage guidelines and terms delineated within this agreement.
Abuse of Services: Any use of our services that disrupts the normal operation, affects performance, or interferes with the experience of other users is strictly prohibited.
Illegal Activities: Use of our services for any unlawful purposes, including but not limited to the transmission, storage, or sharing of illegal content or materials, is not allowed. Using our services to breach the Discord Terms of Service is also not allowed.
File Storage: Our services are not intended for file storage purposes. Storing excessive or disproportionate amounts of files, data, or content unrelated to server operations is prohibited.
Resource Abuse: Any activity that excessively consumes system resources, bandwidth, or network capacity to the detriment of other users is not permitted.
9. Legal Compliance
9.1. Compliance with Laws: Users must comply with all applicable laws, regulations, and third-party agreements while using Dires Hosting services. Any violation may result in immediate termination without refunds.
10. Support Services
10.1. Support Policy: Dires Hosting endeavors to respond to service-related queries within a specified timeframe.
11. Backups and Data Management
11.1. Backup Services: Dires Hosting provides backup services subject to specific terms and conditions. Users must adhere to backup guidelines and understand the limitations and restoration procedures.
11.2. Data Responsibility: Users are responsible for their data. Dires Hosting is not liable for data loss, corruption, or unauthorized access due to user actions or improper configurations.
11.3. Inactive Server Deletion
11.3.a. Free Plan: For users under the free plan, Dires Hosting reserves the right to delete servers that have been inactive for 2 weeks without prior notice and without creating backups of the server files. An "inactive server" is defined as a server marked as offline and not running or online during the specified period.
11.3.b. Storage Hosting: Dires Hosting emphasises that its services are not intended for storage hosting purposes. Users are advised to regularly access and utilise their servers to prevent deletion due to inactivity. Dires Hosting shall not be responsible for any loss of data resulting from the deletion of inactive servers.
12. Termination and Suspension
12.1. Termination Criteria:
a. Non-Payment: Failure to submit timely payments for subscribed services may result in immediate termination without notice.
b. Abuse of Services: Any actions deemed as abuse of services, including but not limited to violating our Fair Use Policy (refer to Section 8), may lead to the immediate termination of services without prior notice.
c. Data Retention: Upon service termination, all associated data and accounts will be permanently deleted. Dires does not retain or provide access to data after service termination. Ensure to back up your data prior to service termination as there will be no way to retrieve it afterward.
d. Inactive Servers: Refer to section 11.
13. Miscellaneous Provisions
13.1. Giveaways: Any giveaways or promotional activities organized by Dires Hosting should have clear rules and guidelines, including the company's discretion in prize allocation or withdrawal.
13.2. By creating an account you agree to all of our terms and give consent to receive important announcements sent via email.
14. Modification of Terms
14.1. Dires Hosting reserves the right to update or modify these Terms of Service at any time without prior notice. Users are encouraged to review the Terms regularly for any changes. Continued use of our services after modifications constitutes acceptance of the updated Terms.
15. Termination for Violation of Other Websites' Terms of Service
15.1. Termination Rights: Dires Hosting reserves the right to terminate a user's account if it is found that the user is utilising our services in a manner that violates the Terms of Service of another website or online platform.
15.2. Investigation: Upon receiving credible information or complaints regarding a user's activities that breach the Terms of Service of another website, Dires Hosting may conduct an investigation to ascertain the validity of such claims.
15.3. Termination Process: If, after a thorough investigation, it is determined that a user is in violation of another website's Terms of Service, Dires Hosting may, at its sole discretion, terminate the user's account and server without prior notice.
15.4. No Refunds: Termination under this section does not warrant refunds to the user.
15.5. Notification: In cases where termination is initiated under this provision, the affected user will be notified of the reason for termination and the specific violation that led to this action.
16. Continued Use After Termination
16.1. Users whose accounts have been terminated under this provision are prohibited from re-registering or creating new accounts with Dires Hosting.
16.2. Any attempt to circumvent the termination by creating new accounts may result in further action, including legal proceedings if deemed necessary.
17. Single Account per Device/Household
17.1. Account Entitlement: Each device or household is entitled to register and maintain one account with Dires Hosting.
17.2. Circumvention Prohibited: Users are prohibited from attempting to circumvent this policy by creating multiple accounts from the same device or household.
17.3. Prohibition of Proxies and VPNs: The use of proxies and VPNs to manipulate or disguise the origin of account registration or access is strictly prohibited. Any attempt to use proxies or VPNs for circumventing the single account per device/household policy may result in immediate termination of all associated accounts without prior notice.
17.4. Termination Without Notice: Violation of the single account per device/household policy or the prohibition of proxies and VPNs may result in the immediate termination of all associated accounts without prior notice.
17.5. No Refunds: Termination under this section does not warrant refunds to the user.
